چکیده

In April, NHS England published a national whistleblowing policy. “Don’t wait for proof,” it said. “It doesn’t matter if you turn out to be mistaken as long as you are genuinely troubled . . . You will not be at risk of losing your job or suffering any form of reprisal as a result.” In 2014 a junior doctor, Chris Day, was covering intensive care when two locum doctors booked to work didn’t turn up. Day made a “protected disclosure,” a legal process designed to protect whistleblowers, to tell managers that he was dangerously overstretched and that the ward was unsafely staffed. Day claimed that he was subsequently victimised by the trust and by Health Education England (HEE); the dispute that followed cost him his training number. He ended up losing his training place, with HEE opposing him in court arguing about who was responsible for his employment. The court found that, because Day was employed by a trust, he had no claim against HEE, which would have been responsible for organising his ongoing appointments. The court concluded that “this is not a case of a gap within the boundaries of protection, but a case in which the relationship falls well outside those boundaries.” Yet HEE had control of his training number and place of work and contributed to his salary—thus, it controlled his employment.

Margaret McCartney: Staff hold the answer to our failing NHS.

The NHS will not suddenly fail. Instead, it’s being made to fail in degrees. The workplace will become unbearably stressful. Staff will leave or work fewer hours. Patients will be less well cared for as gaps on rotas widen. General practices will go bust. Schoolchildren will read the headlines, see the hours doctors work, and think: maybe medicine’s not for me. The small cracks in the NHS that ...

Margaret McCartney: Stand with junior doctors.

When I turned up for my first day as a doctor there was no pre-written rota. Sort it out among yourselves, we were told. When it was busy we stayed late, and when it was quiet we sent home the junior who had been up all night. We were expected to do a good job; in return, we had professional flexibility. I graduated with debt but no tuition fees. I could afford to rent a place and then get a mo...

Margaret McCartney: Fighting for the NHS's moral life.

Contracts are about to be rewritten, for GPs in England and for consultants. Junior doctors are getting a new one. Yawning gaps exist in out-of-hours GP and junior hospital rotas. Emergency department waits are increasing, as are complaints to the General Medical Council, and morale is disintegrating. Is this the NHS’s decline and fall? Doctors used to have much autonomy, leading to innovation,...

Margaret McCartney: A sexist contract for junior doctors.

The Department of Health has published the contract about to be imposed on junior doctors in England, along with a related “equality analysis” and a “family test.” 2 Evenwith an imposed contract, the government has duties under the Equalities Act: UK law forbids direct discrimination against women and disabled people. And the department’s self penned analysis concludes that the contract is “fai...
